Understanding Professional Tax in India

If you are a salaried employee working in India, you might have noticed a small deduction in your monthly payslip labeled "Professional Tax" or "PT". Unlike Income Tax which is collected by the Central Government, Professional Tax is collected by the State Government. The revenue generated from this tax is typically used for the Employment Guarantee Scheme and other state welfare programs.

How Professional Tax Slabs Work

Because Professional Tax is a state subject, there is no uniform rate across the country. Each state government determines its own income slabs and corresponding tax rates, subject to the constitutional maximum of ₹2,500 per year.

  • Maharashtra: Men earning above ₹10,000/month pay ₹200 for 11 months and ₹300 in February (Total: ₹2,500). Women earning up to ₹25,000/month are exempt; above ₹25,000 they pay the same as men.
  • Karnataka: Only one slab exists. Anyone earning more than ₹25,000 per month pays a flat ₹200 per month (Total: ₹2,400/year).
  • West Bengal: Has multiple slabs. Income ₹10,001–₹15,000 pays ₹110/month. ₹15,001–₹25,000 pays ₹130/month. ₹25,001–₹40,000 pays ₹150/month. Above ₹40,000 pays ₹200/month.
  • Tamil Nadu: Tax is collected half-yearly. For example, half-yearly income ₹75,001-₹1,00,000 pays ₹1,045 every 6 months. Above ₹1,25,000 pays the maximum ₹1,250 every 6 months.

Compliance and Penalties

Failure to register, deduct, or remit Professional Tax can lead to severe penalties for employers and professionals. Penalties typically include a fixed fine (e.g., ₹5 per day of delay) plus interest on the late payment (usually 1.25% to 2% per month). Non-compliance can also result in prosecution under state tax laws.

FAQ

Professional tax (PT) is a direct tax levied by state governments in India on all individuals who earn a living through either salary or by practicing a profession (like doctors, lawyers, chartered accountants). Despite its name, it applies to almost all salaried employees, not just 'professionals'.
Under Article 276(2) of the Indian Constitution, the maximum professional tax that any state government can levy on an individual is strictly capped at ₹2,500 per financial year. This limit was set in 1988 and remains unchanged.
No. It is a state-level tax, and only certain states have enacted laws to collect it. States that levy PT include Maharashtra, Karnataka, West Bengal, Tamil Nadu, Andhra Pradesh, Telangana, Gujarat, and Assam. States and UTs like Delhi, Haryana, Rajasthan, and Uttar Pradesh do not currently levy professional tax.
For salaried employees, the employer is legally obligated to deduct the professional tax from the employee's monthly salary and deposit it with the state government. Self-employed individuals and professionals must register themselves and pay the tax directly to the commercial tax department of their respective states.
Yes, the amount paid as professional tax during the financial year is allowed as a deduction from your gross salary under Section 16(iii) of the Income Tax Act, 1961. This deduction is available under both the Old and New Tax Regimes.
Yes, exemptions vary by state. Common exemptions often include senior citizens (e.g., above 65 years in Maharashtra), parents of children with permanent disabilities or mental retardation, deaf/dumb/blind individuals, and armed forces personnel. You should check your specific state's PT Act for exact exemption criteria.
